Attorney Fees Provision in HBOR is Changing the Game.

At the beginning of 2013, the Homeowner Bill of Rights (“HBOR”) went into effect.  While there are numerous provisions in this law, one provision that attorneys and consumers have quickly been taking advantage of is the right to move for attorney fees after a preliminary injunction.  [Civil Code §2924.12, 2924.19].  Normally, parties cannot move for their attorney fees until after the lawsuit is concluded.  However, by allowing for attorney fees earlier, borrowers have been able to move for attorney fees immediately after prevailing on the motion for preliminary injunction and reaching a settlement based on the threat of an attorney fees motion.  This may be one of the reasons why foreclosure starts have dropped in half since December 2012.
